Terms of Service

These Terms of Service (“Terms”) govern your use of Mintmade (the “Service”), provided by Banana Holdings. By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service

Mintmade generates presentations from your prompts using AI, with export as an editable PowerPoint (.pptx) file, PDF, or PNG images, and offers related features such as brand-kit theming and AI image generation.

Accounts

You sign in using a Google or Microsoft account. You are responsible for all activity under your account and for keeping your access secure. You must provide accurate information and be at least 16 years old (or the age of majority in your jurisdiction).

Subscriptions, billing, and renewals

Certain features require a paid subscription, billed through Stripe on a monthly or annual basis depending on the plan you choose. Subscriptions renew automatically at the end of each billing period at the then-current price until cancelled. Your plan includes monthly limits on deck exports and AI image generation, shown in the app; these limits reset each month. We may change prices or plan features and will give reasonable notice of material changes, which apply at your next renewal.

Cancellation and refunds

You can cancel at any time from the billing portal in your account. When you cancel, your subscription remains active until the end of the current billing period, after which it will not renew. Except where required by law, payments are non-refundable, and we do not provide refunds or credits for partial billing periods or unused generations.

Acceptable use

You agree not to use the Service to:

• generate or distribute unlawful, infringing, harmful, hateful, or deceptive content;
• violate the rights of others, including intellectual-property and privacy rights;
• attempt to bypass usage limits, security, authentication, or rate limits;
• reverse-engineer, scrape, resell, or overload the Service; or
• submit content that violates the terms of the AI providers we rely on.

We may suspend or terminate accounts that violate these Terms.

Your content and intellectual property

As between you and us, you own the inputs you submit and the decks generated for you. You grant us a limited license to host, process, and transmit your content as needed to operate and provide the Service, including sending it to the AI providers described in our Privacy Policy. We own the Service itself, including its software, design, and trademarks.

AI-generated content and accuracy

Decks and images are generated by AI and may be inaccurate, incomplete, or not unique. You are responsible for reviewing and verifying all content before relying on or presenting it, and for ensuring your use and outputs comply with applicable laws and third-party rights.

Third-party services

The Service relies on third parties, including Google, Microsoft, OpenAI, Stripe, Supabase, and the AI providers described in our Privacy Policy. Your use of those features is also subject to their terms, and we are not responsible for their services.

Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the Service will be uninterrupted, secure, or error-free.

Limitation of liability

To the maximum extent permitted by law, Banana Holdings will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or USD 100.

Indemnification

You agree to indemnify and hold Banana Holdings harmless from claims arising out of your content or your use of the Service in violation of these Terms or applicable law.

Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service. Provisions that by their nature should survive termination will survive.

Governing law

These Terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to conflict-of-laws rules.

Changes to these Terms

We may update these Terms from time to time. We will revise the “Last updated” date above and, for material changes, take reasonable steps to notify you. Continued use after changes take effect means you accept them.
